TOWN OF GLENVILLE
ZONING BOARD OF APPEALS


        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, August 22, 2011 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.

        Application of Capital Architecture, on behalf of Anthony Ruggerio, property owner, for a Conditional Use Permit to allow for the expansion of the Flight Line Pub, 20 Saratoga Road, Glenville, NY 12302.   Said property is located in a General Business Zoning District and is identified on tax map 30.6-3-9.
        In accordance with the Codes of the Town of Glenville 270-126: Expansion of Conditional Use.  Any expansion or alteration of a conditional use, whether it be the expansion or reconfiguration of the principal building, parking lot, driveways, accessory buildings, etc., is subject to the review procedures as outlined.


        Application of Susan Tiemann, 161 Birch Lane, Glenville, NY  12302 for an Area Variance that will allow for the construction of a new 28’ x 28’ attached garage located 10’ from the side lot line.   The existing attached garage will be demolished as part of this project.  Said property is located in a Suburban Residential Zoning District and is identified on tax map 15.20-3-14.
        In accordance with the Codes of the Town of Glenville 270-Attachment 1:  Dimensional Regulations.  The minimum side setback in the Suburban Residential Zoning District shall be 15’.  Therefore, the applicant is seeking a 5’ variance.


        Application of Maureen T. McKenzie, 14 Hillside Drive, Glenville, NY  12302 for an Area Variance that will allow for the construction of a new 22’ x 30’ two story addition located 10’ from the side lot line.  The addition will consist of a two stall garage on the 1st floor and 2 new bedrooms on the second floor.  The existing 2 stall garage area will be converted into a recreation room.  Said property is located a Suburban Residential Zoning District and is identified on tax map 29.8-4-20.
        In accordance with the Codes of the Town of Glenville 270-Attachment 1:  Dimensional Regulations.  The minimum side setback in the Suburban Residential Zoning District shall be 15’.  Therefore, the applicant is seeking a 5’ variance.


        Application of Charles H. Mitchell Jr., 5 Kile Drive, Glenville, NY 12302 for Two Area Variances that will allow for the construction of a new 20’ x 14’ detached garage located 5’ from the side lot line and 4’ from the dwelling.  The existing legally non-conforming detached garage will be demolished and the new garage built in the same location.  Said property is located in a Suburban Residential Zoning District and is identified on tax map 15.8-4-8.
        In accordance with the Codes of the Town of Glenville 270-Attachment 1: Dimensional Regulations.  The minimum side setback in the Suburban Residential Zoning District shall be 15’.  Therefore the applicant is seeking a 10’ variance.  And, 270-3: Definitions:  Accessory Building or Structure shall be located at least 10’ from the principal building.  Therefore, the applicant is seeking a variance of 6’.
        Application of Larry Haight, 258 Riverside Place, Alplaus, NY  12008 for an Area Variance that will allow for the construction of a new 14’  x 30’ detached garage in the front yard.  The front portion of the property is located in a Suburban Residential Zoning District. The rear portion of the property is located in the Land Conservation Zoning District and the 100 year flood zone.  The property is identified on tax map 23.18-3-16.
        In accordance with the Codes of the Town of Glenville 270-9 (C): Location. No permitted accessory use or building shall be located in any front yard.  Therefore, the applicant is seeking total relief from this section of the ordinance.
